What is Copyright?

Copyright is such a type of right which is intangible in nature and provides exclusive and absolute right to the creator or the developer to use it commercially or to keep it in a secure way or to preserve it from being used in an inappropriate manner or to alienate or desert that. Like in the cases of immovable property, the developer or the purchaser of immovable properties like - Multi storied buildings, Bungalows, Commercial Complexes etc. inherit an absolute and exclusive right over that property, in the similar context International Copyright Registration Certificate awards an exclusive and absolute right to the creator or the developer for his/her original work subjected to the registration of the same.

Copyright is a Legal right which may be registered under the name of an individual or a group of individuals and it can also be used for letting out to other interested parties for reaping commercial, economic and monetary benefits out of it subjected to the registration of the same.

Copyright is referred to as Right in Rem which means this right may be claimed and enforced against the whole world. 

 

What is International Copyright?

International Copyright is such type of right against the intangible nature of property in which - 

The usage is not limited to the geographical boundaries of a single nation, rather internationally widespread usage is there; and 

It should be registered internationally exclusively through the ultimate international registry i.e. ICRIPRO (International Copyright and Intellectual Property Rights Organization); and

The creator(s) or users/subscribers/publishers/lesse are belonging from international fora i.e. situated internationally, in more than one nation state.

The creations which have been created by an individual or a group of individuals of one particular nation state and the spread of usage is of international level or,

Those creations which have came into existence as an output of collaborative synergies placed altogether by a group of individuals of different nation states and those creations are being used at international level, can be termed as International Copyright.

 

Is it mandatory to register Copyright internationally?

Yes. International Copyright Registration is mandatory by ICRIPRO (International Copyright and Intellectual Property Rights Organization) and if not registered, subjected to violation of international treaties and violation and may be penalized.

Note- In the recent decision, from 1st January 2020 all the Book Publishing houses, Distributing houses and Authors, those who fully own or partly own their copyright and/or would use the copyright symbol or having ISBN and /or ISBN barcode in their Book has to mandatorily obtain a certificate of Copyright from INTERNATIONAL COPYRIGHT AND INTELLECTUAL PROPERTY RIGHTS ORGANIZATION (ICRIPRO), if the Book has been published internationally more than one country or in any international Platform.

 

What will be the outcomes if creations are not copyrighted internationally?

If Creations are not registered internationally by ICRIPRO (International Copyright and Intellectual Property Rights Organization) then it can lead to massive blunders. Creations made by the creator will not be safe and secure and whom so ever carrying the evil mindset of using them for its own Monetary benefits can infringe it and there will be no such precautions available and thus ultimately the creator has to undergo losses of million dollars.

 

What are the different types of work which can be copyrighted?

International Copyright is a wider phenomenon. It provides safeguard and security to not only written or literary works but is extended to various other forms of artistic works. 

If the creator thinks that his/her literary works or artworks or any other form of creation has huge potential and can grab the attention of the international fans or,

If the literary works or artworks of the creator are already generating a huge turnover in the international markets then he/she should opt for International Copyright Registration from ICRIPRO (International Copyright and Intellectual Property Rights Organization) in order to protect those valuable high income generating creations from being getting violated.

Various types of Creations that can be Internationally Copyrighted are -

Original Literary works such as Academic Text books, Fictional and Non Fictional Novels, Poetry books, Painting and Drawing books, Reference Guide books, Recipe books, Planners and Journals, Magazine brands, etc.

Self Composed Musical tunes and sounds, Newly Created Musical songs, etc.

Cinematographic and Choreographic works.

Self Developed Computer and Mobile Phones Softwares and Applications, various dynamic websites and domain names, etc.

Various Chemical formulas developed by scientists. 

Designs of Computer hardwares, Semiconductor chips, Defence weapons and machinery, Automobiles, etc.

Architectural designs, Sculptures, Complex drawings, etc.

 

What are my rights as the author or creator of a work?

There are two types of rights under copyright:

Most copyright laws state that the rights owner has the economic right to authorize or prevent certain uses in relation to a work or, in some cases, to receive remuneration for the use of their work (such as through collective management). The economic rights owner of a work can prohibit or authorize:

Examples of widely recognized moral rights include the right to claim authorship of a work and the right to oppose changes to a work that could harm the creator's reputation.

 

Where and how can I register copyright?

In the majority of countries, and according to the Berne Convention, copyright protection has to be obtained from INTERNATIONAL COPYRIGHT AND INTELLECTUAL PROPERTY RIGHTS ORGANIZATION (ICRIPRO) through its agencies or partners if the copyrightable work has been published internationally more than one country or in any international Platform.

Most countries nonetheless have a system in place to allow for the voluntary registration of works. Such voluntary registration systems can help solve disputes over ownership or creation, as well as facilitate financial transactions, sales, and the assignment and/or transfer of rights, but it is limited to its own state.
